When a person has suffered some form of injury (either physical or psychological), it is called a personal injury. Personal Injury may by the result of an accident or medical malpractice.

Accidents at work, road traffic accidents, assault claims, tripping accidents, accidents in the home, holiday accidents and defective product accidents: these are the most common types of personal injury. There are surely a plenty types of accident; personal injury term also incorporates dental and medical accidents and conditions which are mostly classified as industrial disease cases. Industrial disease type cases may include: Mesothelioma and asbestosis, vibration white finger, chest diseases, occupational deafness, contact dermititus, occupational stress, repetitive strain injury cases and some other, very rare situations.

In the situation, when the accident was the fault of someone else, the injured party may be entitled to monetary compensation from person, company, responsible party, etc. whose negligent conduct caused the injury. In the United States, this system is complex and also very controversial with critics calling for various forms of tort reform. Clients are often represented by attorneys on a so-called "contingency basis". In this basis the attorney does not charge for services until the case is resolved.

In England and Wales is the whole case limited by the rules, where an individual is bringing a claim for compensation. The claimant will lose the right to bring their claim, if he fails to manage the court proceedings to be commenced within 3 years of the date of the accident. However, if the injured party was under the age of 18 (at the time of the accident, not the beginning of court proceedings), then they have up until the day prior to their 21st birthday to commence the court proceedings. In the late 1990s, Legal Aid for personal injury cases was largely abolished and replaced with so-called "no win, no fee" arrangements.
